Article 1: Preamble
These General Conditions of Sale are concluded between on the one hand “HOLI AND LOVE”, SASU (single-member simplified joint stock company) with capital of 20,000 euros, registered with the RCS of La Roche-Sur-Yon under number 917 817 629, whose head office is located at 7, Impasse du Pré Garnier in 85330 Noirmoutier-en-l'Ile, registered in the business directory under the number Siret 917 817 629 00012 and on the other hand, by any natural person or legal entity wishing to make a purchase via the website “www.holiandlove-eshop.com” hereinafter referred to as “the customer”.
Article 2: Purpose
These conditions of sale aim to define the contractual relations between HOLI AND LOVE and the customer as well as the conditions applicable to any purchase made through the website www.holiandlove-eshop.com . The acquisition of a product through this site implies unreserved acceptance by the customer of these conditions of sale of which the customer acknowledges having read prior to his order. HOLI AND LOVE retains the possibility of modifying its conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the customer.
Article 3: Products
The products offered are those which appear on the site www.holiandlove-shop.com while stocks last. HOLI AND LOVE reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description including its main technical characteristics (dimensions, components, maintenance advice). The photographs, the exclusive property of HOLI AND LOVE, are as faithful as possible but cannot ensure perfect similarity with the product presented. The photographs are used for illustrative purposes only within the limits of technique and the best market standards. HOLI AND LOVE undertakes to make its best efforts to correct errors or omissions as quickly as possible after being informed of them. All texts and images presented on the site www.holiandlove-eshop.com are reserved, for the entire world, under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.
Article 3: Prices
The prices displayed are in Euros (€) all taxes included (TTC), excluding delivery costs. The user will be informed of these upon final confirmation of the order. The value added tax is that in force in France at the time of the Order. HOLI AND LOVE reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the customer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased depending on the total amount of the order and the country of delivery. The customer will be informed of these upon final confirmation of the order. In mainland France and Belgium, for any order greater than or equal to 100 euros including tax, shipping costs are free.
Article 4: Order
All orders are made via the website “www.holiandlove-eshop.com”. The customer who wishes to purchase one or more items on the HOLI AND LOVE website must comply with the following process:
The data recorded by the site www.holiandlove-eshop.com constitutes proof of all transactions between HOLI AND LOVE and its customers. HOLI AND LOVE reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. In the event of an error in the wording of the recipient's contact details, HOLI AND LOVE cannot be held responsible for the impossibility of delivering the product.
Article 4: Payment
Payment of the entire price of the products and delivery is payable in cash when ordering by one of the payment methods offered on the site on the day of the actual order, by credit card or via PayPal.
The order validated by the customer will be considered effective when the secure banking payment center has given its agreement to the transaction and, where applicable, after acceptance of the assumption of risk by the insurer. In the event of refusal by the said center, the order will be automatically canceled and the customer will be notified by email.
The customer is solely responsible for effective payment of the product purchased.
HOLI AND LOVE implements all necessary means to ensure the security and confidentiality of data transmitted online. Two payment solutions are offered on the site www.holiandlove-eshop.com :
1° online payment by bank card (Carte Bleue, Mastercard, Visa) is ensured by a secure solution called Stripe to secure all transactions. Stripe is a highly secure solution, PCI Level 1 certified, the highest level of security.
2° the Paypal payment solution: HOLI AND LOVE also offers the customer a 100% secure payment with Paypal, either for those who have a PayPal account, or without having a Paypal account, the customer can pay with their card of payment. The Paypal service allows you to pay via various payment cards: Carte Bleue, Mastercard, Visa.
In all cases of payment, by credit card or Paypal, the Customer's credit card number is in no way transmitted to the HOLI AND LOVE company and each purchase is confirmed by a receipt.
Payment by Paypal account or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand the cancellation of the card payment, the sums paid will then be recredited. The liability of the bank card holder is not incurred if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the card holder must contest, in writing, the debit with their bank, within 70 days following the transaction, or even 120 days. if the contract binding him to it so provides. The amounts withdrawn are reimbursed by the bank within a maximum period of one month after receipt of the written dispute filed by the holder. No costs for returning the sums may be charged to the holder.
Article 5: Delivery
Orders are processed and delivered Monday through Friday, excluding holidays. Deliveries are made to the address indicated on the order form.
For Belgium, Luxembourg, France, the Netherlands, Spain, Germany, orders can be delivered via Mondial Relay or via Chronopost.
Deliveries to other EEC countries and the world will be delivered via UPS.
Delivery times are given for information purposes only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.
Article 6: Product conformity and complaints
Upon receipt of the order, it is the customer's responsibility to check the content, conformity and condition of the product(s) in the presence of the delivery person.
If the customer notices damage (damaged package, shock, etc.), he must describe it on the dated and signed delivery slip and return it to HOLI AND LOVE (firstname.lastname@example.org) within 3 working days following receipt of products. He must provide supporting documents for the anomalies noted.
In the event that these anomalies prove to be correct, the customer has the choice between requesting the reshipment of the product subject to its availability or the cancellation of his order and its reimbursement.
Article 7: Return and exchanges
Under article L121-20 of the Consumer Code, the customer has a period of fourteen working days from delivery of their order to exercise their right of withdrawal and thus return the product to the seller HOLI AND LOVE for exchange or refund without penalty, except return costs.
HOLI AND LOVE will not provide refunds or compensation in the event that returned packages are lost, stolen or damaged during transport. HOLI AND LOVE reserves the right to refuse returns or exchange requests for any merchandise that does not meet the above criteria.
Returns and exchanges will be processed as soon as possible following receipt of the request. HOLI AND LOVE will agree to refund and/or exchange the goods provided that they are in their original condition and accompanied by their original sales invoice. Please note that we cannot accept worn, used, altered or damaged merchandise. The full amount of the returned product will be re-credited to the credit card used to pay for the product. Your credit card account will be credited when the returned product is processed, and the credit will appear on your next statement.
Article 8: Guarantee
All products supplied by the company HOLI AND LOVE benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code. In the event of non-compliance of a product sold, it may be returned to the HOLI AND LOVE company which will take it back, exchange it or reimburse it. All complaints, requests for exchange or refund must be made by email to the following address: email@example.com within thirty days after delivery.
Article 9: Liability
The company HOLI AND LOVE in the distance selling process is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.
Article 10: Intellectual property
All elements of the site www.holiandlove-eshop.com are and remain the intellectual and exclusive property of the company HOLI AND LOVE. No one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.
Article 11: Personal data
The company HOLI AND LOVE undertakes to preserve the confidentiality of the information provided by the buyer, which he may be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify and delete information concerning him.
